These Terms of Use ("Terms") govern your access to the ChartLens AI website at chartlensai.fria.aiand your use of the ChartLens AI mobile application (together, the "Service"), operated by the ChartLens AI team ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Educational and informational use only

The Service provides AI-assisted chart analysis for educational and informational purposes only. Nothing in the Service constitutes financial, investment, legal, or tax advice, or a recommendation to buy, sell, or hold any security or instrument.

No reliance

You are solely responsible for your trading and investment decisions. You should perform your own research and consult qualified professionals when appropriate. Output generated by artificial intelligence may be incomplete, inaccurate, biased, or outdated.

Eligibility

You must be able to form a binding contract under applicable law to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

Acceptable use

You agree not to:

• Use the Service in violation of any law or regulation;
• Attempt to probe, scan, or test the vulnerability of our systems;
• Interfere with or disrupt the Service or servers or networks connected to the Service;
• Reverse engineer or attempt to extract source code or models except where prohibited limitations cannot be enforced under applicable law;
• Use the Service to transmit malware or harmful content;
• Misrepresent AI-generated content as human professional advice without appropriate disclosure where required.

Accounts and subscriptions

Certain features may require an account or paid subscription. Fees, renewal, and cancellation are governed by the platform provider (for example, Apple App Store) and any in-app disclosures presented to you at purchase. You are responsible for maintaining the confidentiality of your account credentials.

Intellectual property

The Service, including its design, branding, text, graphics, and software, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes in line with these Terms.

Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY DECISIONS YOU MAKE BASED ON CONTENT FROM THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50), IF NO AMOUNTS WERE PAID DIRECTLY TO US FOR THE FEES AT ISSUE.

Indemnity

You will defend, indemnify, and hold harmless us and our affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Service or violation of these Terms.

Changes

We may update the Service or these Terms from time to time. If we make material changes, we will provide notice as required by law, which may include posting an updated Terms page with a new "Last updated" date. Continued use after changes constitutes acceptance of the revised Terms where permitted by law.

Termination

We may suspend or terminate access to the Service if you breach these Terms or if we discontinue the Service. Provisions that by their nature should survive will survive termination.

Governing law and venue

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles that would require the application of another jurisdiction's laws. You agree that any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there, except where applicable law requires a different forum (for example, mandatory consumer protections in your U.S. state of residence).
